4. Services Description

4.1 Web Hosting Services

NairaHost provides various web hosting solutions, including:

Service specifications, resource allocations (disk space, bandwidth, CPU, RAM), and features vary by plan and are detailed on our website and in your service order.

4.2 Domain Registration & Management

NairaHost acts as a domain registrar or reseller for various top-level domains (TLDs) including .com, .ng, .com.ng, .net, .org, and others. Domain registration is subject to:

We offer free Let's Encrypt SSL certificates and premium SSL certificates from trusted Certificate Authorities. SSL services are provided through third-party vendors and are subject to their terms and validation requirements.

4.4 Email Hosting

Email hosting services include email accounts, webmail access, IMAP/POP3/SMTP protocols, spam filtering, and related features as specified in your plan.

4.5 Software Licenses & Add-ons

Certain software licenses, control panel licenses (cPanel, Plesk), and third-party applications are offered as add-ons. These are subject to the respective vendor's licensing terms.

4.6 Service Modifications

NairaHost reserves the right to modify, update, enhance, or discontinue any aspect of our services with reasonable notice. We will make commercially reasonable efforts to maintain backward compatibility and minimize service disruptions.

By enrolling in automatic renewal, you authorize NairaHost to automatically charge your selected payment method for service renewals. You may opt out of auto-renewal at any time through the client area.

5.6 Chargebacks & Payment Disputes

⚠️ Chargeback Policy: Filing a chargeback or payment dispute without first contacting NairaHost support will result in immediate account suspension and potential termination. Chargeback fees (₦5,000-₦15,000) will be assessed. We encourage clients to contact our billing team to resolve any payment concerns before initiating a chargeback.

7. Mandates and Authorisations

By using NairaHost services, the Customer expressly authorises and mandates NairaHost to:

  1. Service Suspension & Termination: Suspend, restrict, or terminate services immediately if payment is not received within the stated time period, or if the Customer violates any provision of these Terms, the Acceptable Use Policy, or applicable laws.
  2. Commission Adjustments: For reseller hosting clients and affiliate partners, deduct, offset, or reclaim commissions, referral fees, or incentives in the event that a referred client:
    • Cancels their service within the first billing period;
    • Receives a refund under our money-back guarantee;
    • Initiates a chargeback or payment dispute;
    • Violates our Terms of Service resulting in account termination.
  3. Policy Enforcement Actions: Take immediate action where necessary to enforce compliance with our Acceptable Use Policy, including but not limited to:
    • Removing or disabling access to Content that violates our policies or applicable laws;
    • Suspending accounts engaged in malicious, abusive, or unlawful activities;
    • Cooperating with law enforcement and legal authorities;
    • Implementing security measures to protect our infrastructure and other clients.
  4. Backup & Data Management: Acknowledge and agree that:
    • Backups provided by NairaHost are for disaster recovery and operational purposes only and are NOT GUARANTEED;
    • Customers are solely responsible for maintaining their own independent, up-to-date backups of all data, files, databases, emails, and Content;
    • NairaHost is not liable for data loss regardless of cause (hardware failure, software malfunction, user error, security breach, or force majeure);
    • Data recovery services, if available, may be provided at additional cost with no guarantee of success.
  5. Administrative & Financial Actions: Apply and collect:
    • Late payment fees, interest charges, or penalties for overdue invoices;
    • Reconnection fees for restoring suspended services;
    • Administrative fees for manual processing, account management, or excessive support requests;
    • Chargeback fees and dispute resolution costs;
    • Collection fees and legal costs for debt recovery.
  6. Service Modifications & Migrations: Modify, upgrade, migrate, or relocate Customer services to different servers or data centers to maintain optimal performance, security, or operational efficiency, with reasonable notice where possible.
  7. Account Verification: Request and verify identification documents, business registration certificates, or other credentials to comply with Know Your Customer (KYC), anti-fraud, or legal requirements.

Violation of the Acceptable Use Policy may result in:

⚠️ Zero Tolerance: NairaHost maintains a zero-tolerance policy for illegal activities, CSAM, and malicious abuse. Such violations will result in immediate termination and reporting to authorities.

9. Resource Usage & Fair Use

While many of our hosting plans advertise "unlimited" resources, all services are subject to fair use policies:

While bandwidth is "unlimited" on most plans, accounts using extraordinary amounts of bandwidth (typically >500GB/month on entry plans) may be reviewed and asked to upgrade.

11. Service Level Agreement (SLA) & Uptime

NairaHost strives to provide 99.9% uptime for all hosting services. This excludes:

NAIRAHOST SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED SERVICE, OR ERROR-FREE OPERATION.

NAIRAHOST SHALL NOT BE LIABLE FOR:

These limitations reflect an allocation of risk that is essential to the basis of the bargain between you and NairaHost.

21. Dispute Resolution & Governing Law

These Terms and Conditions, and any disputes arising out of or related to these Terms or the Services, shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

You irrevocably agree that the courts of Lagos State, Nigeria, shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter or formation.

You agree that any disputes will be resolved on an individual basis. You waive any right to participate in class-action lawsuits or class-wide arbitration against NairaHost.

23. Severability

These Terms and Conditions, together with our Privacy Policy, Refund Policy, and any Service-Specific Terms, constitute the entire agreement between you and NairaHost regarding the use of our services and supersede all prior agreements, understandings, or representations, whether written or oral.

25. No Waiver

The failure of NairaHost to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of NairaHost.

26. Assignment

You may not assign, transfer, or delegate these Terms or your account to any third party without NairaHost's prior written consent. NairaHost may assign these Terms to any affiliate, successor, or acquirer without your consent.
