Terms and Conditions

Welcome to NairaHost (“we”, “our”, “us”). These Terms and
Conditions (“Terms”) govern your use of our website nairahost.com.ng (the “Site”), our hosting
services, domain registration, and all related products and features provided through our platform and
client area. By using our services, you agree to be legally bound by these Terms.
1. Acceptance of Terms
By accessing or using NairaHost services, you affirm that you are at least 18 years of age and legally
capable of entering into a binding contract. If you use our services on behalf of an organization, you
represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you must not use our services.
2. Key Definitions
- Client / User: any individual or entity using NairaHost services.
- Services: includes shared hosting, VPS, dedicated servers, reseller hosting, domain
registration, SSL certificates, and related support.
- WHMCS Client Area: the portal through which clients manage services, billing, and
support.
- Content: all data, websites, applications, files, or information uploaded, hosted, or
managed by the client on NairaHost infrastructure.
3. Account Registration & Responsibilities
- Clients must provide accurate and complete information when registering an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities
under your account.
- You agree to notify NairaHost immediately if you suspect unauthorized use of your account.
- Accounts may not be shared or transferred without written permission.
4. Services Provided
4.1 Web Hosting
We provide shared hosting, reseller accounts, VPS, and dedicated servers. Availability, features, and
resource allocations vary by plan.
4.2 Domain Registration
NairaHost acts as a registrar or reseller for domain names. Registration is subject to ICANN policies and the
specific registry’s terms. Domain availability is not guaranteed until confirmed by the registry.
4.3 SSL Certificates & Add-ons
SSL certificates, email hosting, and other add-ons are offered through third-party providers. By purchasing
these, you also agree to the third-party provider’s policies.
5. Billing & Payments
- All prices are listed in Nigerian Naira (NGN) unless otherwise specified.
- We accept payments through Paystack, Flutterwave, bank transfer, and other listed methods in the client
area.
- Services are provisioned after payment confirmation.
- Invoices must be paid on or before the due date to avoid suspension.
- Late or failed payments may result in service suspension or termination.
- Refunds are granted at NairaHost’s discretion and may be subject to restrictions (see section on Refund
Policy).
6. Refund Policy
We aim for transparency in billing. Refund terms include:
- Hosting: eligible for a refund within 7 days of purchase if the service is
unsatisfactory, except for violations of our Acceptable Use Policy.
- Domains: domain registrations and renewals are non-refundable once registered with a
registry.
- Third-party services: SSLs, licenses, and add-ons are non-refundable after activation.
All refunds are processed via the original payment method where possible.
7. Acceptable Use Policy (AUP)
Clients must not use NairaHost services for unlawful or abusive purposes. Prohibited activities include:
- Hosting or distributing malware, phishing content, or fraudulent websites.
- Sending unsolicited bulk email (spam).
- Storing or transmitting child sexual abuse material (CSAM) or extremist content.
- Violating intellectual property rights.
- Resource abuse (excessive CPU, RAM, bandwidth beyond fair usage).
- Running illegal online gambling, scams, or Ponzi schemes.
Violation may result in suspension or termination without refund.
8. Service Availability & SLA
NairaHost strives for 99.9% uptime on hosting services. However, we do not guarantee uninterrupted access and
are not liable for downtime caused by:
- Scheduled maintenance or emergency maintenance.
- Force majeure events (natural disasters, internet backbone issues, government actions).
- Client misconfigurations or third-party scripts/plugins.
We provide credits for downtime at our discretion, not cash refunds.
9. Backups & Data Responsibility
- NairaHost maintains regular backups for disaster recovery.
- Backups are provided as a courtesy and not guaranteed.
- Clients are solely responsible for maintaining their own up-to-date backups.
- NairaHost is not liable for data loss caused by client error, hardware failure, or unforeseen incidents.
10. Intellectual Property
Content uploaded by clients remains their intellectual property. However, you grant NairaHost a limited
license to store, reproduce, and transmit content for the purpose of delivering services.
NairaHost trademarks, logos, and site content are owned by NairaHost and may not be used without permission.
11. Limitation of Liability
To the maximum extent permitted by law:
- NairaHost shall not be liable for indirect, incidental, or consequential damages, including loss of
data, profits, or business opportunities.
- Total liability in any event shall not exceed the amount paid by the client in the preceding 6 months
for the affected service.
12. Indemnification
Clients agree to indemnify and hold harmless NairaHost, its employees, partners, and affiliates from claims,
damages, or expenses arising from misuse of services or violation of these Terms.
13. Termination
- Clients may cancel services at any time through the client area.
- NairaHost may suspend or terminate services for non-payment, policy violations, or unlawful use.
- Upon termination, all data associated with the account may be permanently deleted.
14. Privacy Policy
Your use of our services is also governed by our Privacy Policy, which
explains how we collect, process, and protect your personal information.
15. Dispute Resolution
- Most issues can be resolved by contacting support at support@nairahost.com.ng.
- If unresolved, disputes will be handled under the laws of Nigeria.
- Exclusive jurisdiction lies with courts in Lagos, Nigeria.
16. Force Majeure
NairaHost is not responsible for delays or failures caused by events beyond our reasonable control, including
acts of God, strikes, internet outages, government restrictions, or third-party failures.
17. Modifications to Terms
We may update these Terms at any time. The “Last updated” date at the top reflects the latest version.
Continued use of services after updates constitutes acceptance.
